At Product Gale, we operate a pay-as-you-go service model where you are charged based on your actual usage of our AI-powered product data curation platform. This Refund Policy explains our policies regarding refunds and billing.

PAY-AS-YOU-GO BILLING MODEL

Product Gale operates on a pay-as-you-go basis, not a traditional subscription model. You are charged based on your actual consumption of our services. All payments are processed through our payment processor, Lemon Squeezy, who serves as the Merchant of Record for all transactions.

Important: Our service utilizes third-party AI providers (including OpenAI, Claude, Gemini, and others) to deliver our product data curation and classification capabilities. When you use our service, we incur real costs from these providers based on your usage. Once our AI systems process your data, these costs cannot be recovered.

You can monitor your usage and associated costs through your account dashboard. Invoices are generated based on your consumption during the billing period.

REFUND ELIGIBILITY

Due to the nature of our pay-as-you-go service and the real costs we incur from third-party AI providers when processing your data, refunds are only provided in the following specific circumstances:

  • Billing Errors and Cost Miscalculations: If there is an error in how your usage was calculated or billed, resulting in an incorrect charge amount, we will refund the difference. This includes system errors, double billing, or miscalculations in usage metrics.
  • Duplicate Charges: If you have been charged more than once for the same usage or billing period, the duplicate charge will be refunded in full.
  • Unauthorized Charges: If charges were made to your account without your authorization due to security breaches or fraudulent activity, we will investigate and refund legitimate claims.

NON-REFUNDABLE CIRCUMSTANCES

Because we incur immediate, non-recoverable costs from third-party AI service providers when processing your data, refunds are not available for:

  • Services Already Consumed: Once our AI systems have processed your product data, the associated costs have been incurred and cannot be refunded.
  • Dissatisfaction with Results: Refunds are not provided based on dissatisfaction with classification results, output quality, or service performance. We encourage you to test our service with small volumes before processing large datasets.
  • Change of Mind: Refunds are not provided if you change your mind after processing has been completed.
  • User Error: Refunds are not provided for unintended usage, such as accidentally processing data or submitting incorrect datasets.
  • Service Interruptions: Temporary service outages or performance issues do not qualify for refunds of previously consumed services.
  • Account Termination: If your account is terminated due to violation of our Terms of Service, no refunds will be provided for any prior usage.

Cost Transparency: We provide clear pricing information and usage tracking tools to help you monitor and control your costs. It is your responsibility to monitor your usage and understand the associated costs before processing data.

HOW TO REQUEST A REFUND

If you believe you have been incorrectly billed or there has been a cost miscalculation, please follow these steps:

  2. Include your account email address and transaction ID or invoice number
  3. Provide detailed information about the billing error or cost miscalculation, including:
    • Expected vs. actual charges
    • Screenshots of usage metrics if applicable
    • Any other relevant documentation
  4. Our team will investigate the issue and respond within 3-5 business days

We will thoroughly review all billing error claims. If a billing error is confirmed, we will process a refund for the incorrect amount.

REFUND PROCESSING TIME

Once a billing error is confirmed and your refund request is approved:

  • Refunds are processed through Lemon Squeezy within 5-7 business days
  • The refund will be credited to the original payment method used for the purchase
  • Depending on your bank or credit card company, it may take an additional 5-10 business days for the refund to appear in your account
  • You will receive a confirmation email once the refund has been processed

USAGE MONITORING AND COST CONTROL

To help you manage your costs and avoid unexpected charges:

  • Real-time Usage Dashboard: Monitor your current usage and estimated costs in real-time through your account dashboard
  • Usage Alerts: Set up optional alerts to notify you when you reach certain usage thresholds
  • Billing Estimates: View estimated costs before processing large datasets
  • Historical Reports: Access detailed reports of your past usage and charges

We strongly recommend monitoring your usage regularly and starting with small test batches before processing large volumes of data.

ACCOUNT MANAGEMENT

You can manage your account at any time:

  • Pause Usage: You can pause or stop using the service at any time. You will only be charged for what you've already consumed.
  • Close Account: You may close your account at any time by contacting support. Outstanding balances must be paid before account closure.
  • No Ongoing Commitment: There are no long-term contracts or commitments. You pay only for what you use.

TESTING AND TRIAL USAGE

We encourage new users to:

  • Start with small test batches to evaluate the service quality and results
  • Review pricing information and cost estimates before large-scale processing
  • Contact our support team if you have questions about expected costs for your use case

By using our service, you acknowledge that you understand the pay-as-you-go pricing model and that charges are based on actual consumption of AI processing resources.

EUROPEAN UNION CONSUMERS

If you are a consumer located in the European Union, please note that the EU Consumer Rights Directive's 14-day withdrawal right applies to purchases of goods and certain services. However, for digital content and services that are fully performed with your prior express consent, the right of withdrawal does not apply once the service has been fully performed.

By using Product Gale's pay-as-you-go service and initiating data processing, you expressly agree to the immediate performance of the service and acknowledge that you lose your right of withdrawal once the AI processing of your data has been completed.

You retain the right to request refunds for billing errors and cost miscalculations as outlined in this policy.

CHARGEBACKS

If you file a chargeback or payment dispute with your bank or credit card company without first contacting us to resolve the issue:

  • Your account will be immediately suspended pending investigation
  • We will provide documentation of services rendered to dispute illegitimate chargebacks
  • Chargeback fees and costs may be pursued for fraudulent or unjustified claims
  • We reserve the right to permanently terminate accounts with a history of unjustified chargebacks
